LOCAL HEALTH DEPARTMENT COVID-19 RULES

Many local health departments have established rules placing health and safety requirements on businesses amidst the COVID-19 pandemic.  These local rules may seem at first blush to be similar to those established by state or federal agencies, but it is important to understand that they often impose additional requirements.  Typically, these local rules establish screening and social distancing policies.  For example, Saginaw County’s Public Health Emergency Order SCHD 2020-02, requires businesses to:

  1. Develop and implement a daily screening procedure for all employees who report to work;
  2. Develop and implement a social distancing plan for all employees who work in shared spaces;
  3. Develop and implement a social distancing plan for all customers who are waiting for services inside or outside of the business; and
  4. Publish a copy of the Public Health Emergency Order SCHD 2020-02 at all facility entrances.

Employers must be careful to follow any and all obligations created by these local rules.  Indeed, health department violations could lead to facility closure, citations, penalties, and a whole host of other problems.
